Age of consent to sex goes upLEGAL NEWSAs of May 1 2008 Canada’s age of consent to sex is 16 - the previous age of consent was 14. This is the first change to Canada’s age of consent in over 100 years. The changes to the Criminal Code include a ‘close-in-age’ exception, which allows a 14 or 15 year old to consent to sex with a partner who is less than 5 years older, as long as the older partner is not in a position of trust or authority towards the younger person, and the relationship is not exploitative.
